ADVENTURER/USER TERMS OF SERVICE
Welcome to Call to Adventure (the 'Site'). We operate an adventure and outdoors-related publisher as well as a platform which allows you to book amazing handpicked adventures. We'll refer to our website and other services as our "Services", and Call to Adventure will be addressed individually or collectively as “Call to Adventure”, “CTA” "Calltoadventure", "we", "us", or "our". Do read through the following Terms of Service carefully before using the Site or any of our Services. By browsing our Site (including all sub-domains), you'll be agreeing to our Terms.
The Terms are here for you, so that you are aware of your legal rights when using our services.Call to Adventure is the trading name of CALLTOADVENTURE LTD whose registered office is at 39 Steeple Close Poole BH17 9BJ. Company number 12112566.This document and any documents referred to within it will collectively make up the 'Terms of Service'.Our "Services" include (a) the site, (b) the services provided by the site, (c) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, video, messages, tags, content, programming, software, application services. Any new features added to or augmenting these services are also subject to these Terms of Service.
Content that is posted by Users (buyers and sellers) using our Services will be referred to as "Your Content". Your Content includes your usernames, profile names, profile pictures, listing photos, listing description, reviews, comments, videos, etc. Our services include an online platform service that provides a place and opportunity for the sale of trips or services between the buyer ("Buyer") and the guide, leader, or company ("Seller"), collectively known as "Users" or "Parties". The actual contract for a sale is directly between the Buyer and the Seller.
We are not a party to that contract or any other contract between Buyer and Seller. Parties to the transaction will be entirely responsible for the sales contract between them in accordance to the listing of goods, warranty of purchase and like. As such, we accept no obligations in connection to these contracts.However, if you have problems with your adventure which cannot be resolved, we will do our best to step in to help. In general, we have vetted and hand-picked the providers to ensure a high level of quality.
We will do our best to ensure the best quality service is delivered. Ultimately though, there is a limit to our ability to influence this for adventures we are not actually delivering ourselves.We reserve the right to change, modify, suspend or discontinue all or any part of this Site or Services at any time.
We may release certain Services or their features while they are still considered to be a beta version, which may not work correctly or in the same way as how the final version may work, and cannot be held liable in such instances.
We may also impose limits on certain features or restrict your access to parts of, or the entire Site or Service at its sole discretion without notice or liability.We reserve the right to refuse to provide you access to the Site or Service or to allow you to open an Account for any reason. We also reserve the right to modify and remove and listings, posts, or accounts created by both buyers and sellers.
Use of site and platform
Do note that by both using and booking through the platform you agree to our terms of service. When you make a booking through the site you are also agreeing to the terms of service operated by the guide, leader, or company operating that trip (the principle). These will be made available to you in due course. If non are supplied then those listed here shall apply.
Be sure to familiarise yourself with them and ensure you consent to them. Should the booking be made and we not be made of any objections to them, that will be taken as consent.
By their nature, adventure and outdoor-related activities involve some degree of risk. We strongly recommend therefore that you have sufficient travel insurance for any trips you book. Ensure that it covers you for all activities you will be doing. This is usually a requirement for booking your trip anyhow as part of the terms of service provided by the guides.
All principles (those actually taking the trips) will have their own participation statement which you must agree to in order to partake. By booking through the platform however you are also subject to our participation statement which details that all participants must be over 18 years old and agree that they have checked and indeed meet the trip requirements as stated.By booking through the platform you must complete a medical and risk declaration form (or similar) and return this before the date of the trip.To be clear, we are purely a platform where suppliers we choose to list can offer their adventures to customers and therefore we accept no liability for any happenings related to the adventure itself. It is, however, our first priority that you have an amazing experience and will do everything we can to ensure that.
Call to Adventure is a participant in the Amazon Service LLC Associate Program, an affiliate advertising program designed to provide a way for sites to earn advertising fees by including links to Amazon.comCall to adventure is a participant in the Amazon EU Associated Program, an affiliate advertising program designed to provide a way for sites to earn advertising fees by including links to Amazon.co.uk and the various Amazon websites in various other European countries (France, Italy, Spain, Germany). In simple terms we may earn a small bit of cash when you buy something on Amazon after clicking on one of our links at no extra cost to you. The price you pay is unaffected by this; it just helps us pay the costs to keep the lights on.
You'll need to create an account with us to use some of our Services. Here are a few rules about accounts with Us:You must be 18 or older to use our Service. Otherwise, you may only use our Services under the supervision of a parent or legal guardian.Be honest with us, and provide accurate information about yourself. It's not acceptable to use false information or impersonate another person or company through your account.You are responsible for your account. You're solely responsible for any activity on your account. If you're sharing an account with other people, then the person's name on the account will ultimately be responsible for all activity. If you're registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.As we've mentioned above, you're solely responsible for any activity on your account, so remember to keep your login and password secure.
We grant you a limited and revocable license to access and use our Services, subject to our Terms of Service. All proprietary content, trademarks, service marks, brand names, logos and other intellectual property displayed in the Site are the property of Calltoadventure and where applicable, third parties proprietors identified in the Site. You agree not to copy, distribute, republish, mirror, frame or create derivative works without our prior written consent.
Content that you post using our Services is your content. This includes usernames, profile names, profile pictures, listing photos, listing descriptions, reviews, comments, video, etc.You are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and you're not infringing or violating any third party's rights by posting it.Posting Your Content through our Services, you grant us a license to use it. This license allows us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify reproduce, distribute, store and prepare derivative works of Your Content to promote the Services or our Site. We do not claim ownership to Your Content, but we have your permission to use it to help us function and grow.If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us. If your Content infringes another person's intellectual property, we will remove it if we receive proper notice.You agree to not post any content that is abusive, threatening, defamatory, obscene, vulgar or otherwise offensive or in violation of our Prohibited Items/Services section. You also agree not to post any content that is false, misleading or uses the Services in a manner that is fraudulent or deceptive.
Your Use of Our Services
We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you.You are responsible for paying all that you owe. You are also solely responsible for collection and/or paying any applicable taxes for any purchases or sales you make through our Services.You agree not to attempt to obtain source code of the services. You agree to not interfere with or disrupt/harm our services.Violations of this policy may result in a range of actions, including any or all of the following: account deletion, account suspension or legal action; if necessary.
Purchase and Payment
Currently, we support a number of payments options. These payments are processed through third-party payment channels and may vary depending on the jurisdiction you are in. You agree to their terms of service by using them.All sales on the platform are binding. The seller is obligated to complete the transaction with the buyer in a prompt manner unless an exceptional circumstance arises.
Disputes as a Customer
You may raise two types of disputes, one where the ‘service is not delivered' and the seller is not responding to any of your attempts to communicate. The second type of dispute is where the 'service is significantly different from that described'.You may pursue a report about a transaction or contact your card provider to pursue any chargeback options that may be available to you from your card provider. However, you may not pursue both options at the same time or seek double recovery in respect of the same transaction. If you raise a dispute with us and subsequently file a chargeback with your card provider (or bank), we will close your report.If you have received a refund/exchange from the seller, you may not report that transaction.If the 'service is significantly not as described', and both parties cannot agree as to the difference between the service that was sold and what was described, we will make a fair decision based on all the information we hold about the item. We will exercise our decision-making authority based on numerous factors, which include the description of the adventure at the point of purchase, communications between you and the seller as well as any documentation provided. All decisions made by us are final.
Disputes with Us
If you are upset with us, please let us know and hopefully we can resolve your issue. If we are unable to resolve the issue, these rules will govern any legal dispute involving our Services:Governing Law. The Calltoadventure's local laws govern the Terms of Service (those of the United Kingdom). The local laws are dependent on the location of incorporation. These laws will then apply no matter where in the world you live.You agree that any dispute or claim arising from the Terms will be settled by arbitration where possible. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis: class arbitrations and class actions are not permitted. Any decisions made by the arbitrator will be deemed final.
Changes to the TermsWe are constantly updating and improving the Service to try and find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect changing technologies, tastes, behaviours and the way people use the Internet and our Service.We may revise the Terms of Service but the most current version will always be available.We will try, where possible and reasonable, to contact you to let you know about significant changes to any of the documents referred to in these Terms of Service. We may make contact through the system or via a separate email.The current version of the Terms of Service contains the only terms that apply to our relationship with you. Older versions of the Terms of Service will no longer apply to our relationship and will be completely replaced by the current version.
Accuracy of information
We do our best to ensure that information on the site is accurate. However, due to the nature of the content on the site, some information will inevitably be outdated. Furthermore, we rely on collaborators and partners to provide some information. We do our best to ensure the information they supply is accurate although again cannot guarantee its accuracy.
You may be supplied with a specific risk charter for your trip but in lieu of that, the following shall apply for all adventures suggested on and booked through any Call to Adventure or related site.
Most of the activities/adventures listed on the site involve risk. You should be fully aware of this before booking. Suppliers will do what they can to negate this risk but there is a possibility of injury or even death, which you accept when booking.
Outdoor activities are weather dependent. Any changes to the itinerary will be made by leaders and are final. If the leader deems a planned activity to be unsafe and change the itinerary accordingly a refund will not be given unless the supplier determines it appropriate. Be assured though that guides will do their best to stick to the scheduled routes and activities.
Call to Adventure aims to foster a sense of community through its adventures. Customers are asked to carefully check the requirements for trips. Occasionally, an objective such as a summit will not be met due to members of the group not meeting the requirements or not being up to the objective in that instance. In this case, the default position is that no refund will be given. The guide may still choose to issue one should they deem it appropriate.
